Handicap discrimination/retaliation, Small Claims or Civil Suit?
I have a debilitating illness and the apartment complex I live in has been a nightmare for me. To make this short I will just list the main points.
We had no heat 12/24 -12/26, deemed a non emergency, 3 months later, no heat for 15 days and I contacted them twice to repair it. No rent credit given when their “policy” states that for each day without repair, credit is given off your rent, they said it wasn’t their fault it wasn’t fixed! I am on a electric medical baseline program.
5 handicap spaces for 330 units, abused constantly even by management. No consequences for violaters, yesterday an ice cream truck was told to park there for a party. 2 weeks after I called security to report violaters, my car was towed from a non HC space with a placard in the window (illegal in CA)
6 leaks in 10 months due to deferred maintainence, master bedroom now smells of mildew.
Threatened with eviction for calling police one time on upstairs neighbor for very loud noise on a daily basis (I tried everything before calling police)
Garage is a few hundred yards away, so I have to park in handicap space (only one is near me), others in this building have a garage right next to our building.
Manager tried an illegal entry into our apartment under the guise of an emergency when there was none. There was a leak the day before from the UPSTAIRS unit, not ours and it had already been repaired (he knew this)
We are given used parts for repairs (used garbage disposal last week)
We had to pay out of pocket to replace items ruined from these leaks.
I need to file at the very least a small claims suit to get back the money that I have lost due to these actions, is this a small claims issue or something larger?

My first recommendation would be that you file a complaint for violations of the Fair Housing Act. This assumes, of course, that you have advised your landlord that you needed accommodations. (You can Google this for more information but landlords are required to provide reasonable accommodations for disabled tenants. If you are being denied accommodations that you have requested, they are violating the FHA. If you are being harassed or abused because of your disability, this is also a violation.)
The website regarding the Fair Housing Act will allow you to file your complaint online. Make sure that your complaint is specific to the disability-based issues. (Don’t include information about loud neighbors. Don’t include information about the manager’s illegal entry, upstairs leaks, used parts, etc. Your complaint needs to be narrowly focused. I suggest that you read the FHA so you understand exactly what violations your landlord committed before you file your complaint.)
Let HUD (and perhaps the Human Rights Commission) investigate you claim. When they are done, then you can file a small claims action for the out of pocket items you had to replace.

Can I sue the extended hotel i’m staying at?
I’m staying in an extended hotel InTown Suites. Things are constantly breaking down since i moved in. The head board fell on top of me while i was sleeping and it took them 2 days to repair.
Now the sink is leaking cause the garbage disposal has been leaking air and has damaged garbage bags laundry soap and other material that has cost me money. It has now been a week and a half since i’ve asked them to fix it they still haven’t.
Neighbor is blasting music through my room 24/7 and i have been asking security for 3 weeks to resolve the problem and they still haven’t.
They say they have a 0 tolerance for drugs and I’m smelling mary jane constantly. I’m going to school that drugs test every 3 weeks tuition is all ready paid for etc. but if i fail the drug test due to second hand smoke etc. i have to pay the tuition of 26 grand I don’t have that kind of cash. If I get kicked out of school for second hand smoke because the hotel did not enforce the policies can i sue them?
P.S. Can I take them to court to reduce rent/payment by 1/3? ( they are over pricing for shit rooms)

I am hearing some loud explosion noise outside my house(or somewhere), when I turn the heat ON. I have a gas furnace in basement.
Can I call the HWA and have them check this for me ?
I am hoping I should not be paying them more than my $100 deductible right ?

The explosion noise you are hearing is due to slow ignition. This means when the furnance starts up it is not igniting the gas straight away, but a few seconds later. By that time, there is a fair amount of gas in the combustion chamber before it is ignited. This needs to be checked out urgently.
